Petrolube Trade - B2B Petroleum & Lubricant Marketplace

Refund Policy:

Petrolube Trade ("Platform") operates solely as a B2B marketplace and advertising facilitator connecting Buyers and Sellers of petroleum products. The Platform does not manufacture, supply, sell, or deliver any products of the sellers partners, and it is not a party to any contract or transaction between Buyers and Sellers. All contractual obligations, payments, refunds, or disputes arising from transactions are exclusively between the Buyer and the Seller. The Platform's role is limited to providing information, advertising products, and facilitating communication between Users. Any funds, payments, or advance amounts collected through the Platform may be held in a custodial or escrow capacity for the purpose of recording the transaction but do not constitute ownership by, or liability of, Petrolube Trade.

1. No Refund Obligation of the Platform:

Under no circumstances shall Petrolube Trade, its directors, officers, employees, or affiliates be liable for any refunds, reimbursements, or financial adjustments related to any transaction. Users acknowledge and agree that: • All refund claims must be addressed directly with the Seller; • The Platform does not guarantee, enforce, or approve any refund; • Any delay, denial, or partial refund arising from a transaction is the sole responsibility of the Buyer and Seller.

2. Documentation Role Only:

Petrolube Trade may, at its discretion, provide tools or records to document refund requests, communications, or transaction details. Such documentation is provided solely for convenience and does not impose any legal obligation on the Platform to act, adjudicate, or resolve any refund claim.

3. Indemnity:

Users agree to fully indemnify, defend, and hold harmless Petrolube Trade, its directors, officers, employees, and affiliates from any and all claims, losses, liabilities, damages, or expenses arising from or related to refund disputes between Buyers and Sellers. This indemnity explicitly covers any direct, indirect, incidental, consequential, or punitive claims.

4. User Acknowledgment:

By using the Platform, Users expressly acknowledge that Petrolube Trade is not a contracting party, and that all financial responsibilities, refund obligations, and contractual disputes rest solely with the Buyer and Seller. Users further acknowledge that the Platform and its personnel cannot be held personally liable for any refund, loss, or damage arising from transactions conducted through the Platform.

5. Governing Law and Jurisdiction:

These Terms and all matters relating to the use of the Platform shall be governed by the laws of India. Users agree that only the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute, claim, or proceeding involving the Platform or arising out of these Terms, including claims relating to its use, access, policies, disclaimers, or the role and conduct of the Platform, its directors, officers, or employees. Users further acknowledge and agree that Petrolube Trade acts solely as a B2B marketplace intermediary and is not a party to any contract, negotiation, transaction, or commercial arrangement between Buyers and Sellers. Any dispute between Buyers and Sellers shall be solely between such parties, and Petrolube Trade shall bear no responsibility, liability, or involvement in such disputes. Buyer–Seller disputes may be resolved in any forum mutually applicable to them, and shall not impose any jurisdictional or legal obligation on the Platform.
